SM.ENTERTAINMENT LEGAL COURT CASE AGAINST THE BANNING OF DBSK'S 4TH ALBUM FOR UNDER 19 .

동방신기 측이 지난 11월 말 청소년보호위원회(이하 청보위)가 동방신기 4집을 청소년 유해 매체물로 판정한 것과 관련, 다음 주 법원에 정식으로 효력정지 가처분 신청을 할 예정이다.

DBSK's 4th album was put under the 19 year age banned by the Youth Safety Association on November, however SM.ENT will starting next week file a legal case against this to the Justice Court/ District Court.

동 방신기 소속사인 SM엔터테인먼트(이하 SM) 측은 6일 오후 머니투데이 스타뉴스에 "이번 행정처분에 대한 효력정지 가처분 신청을 다음 주 중으로 관할 법원에 신청할 계획"이라며 "지난 2일 이번 사안에 대한 SM의 입장을 밝힌 이후, 가처분 신청과 관련한 법적 준비를 해 왔다"고 전했다.

DBSK's Management SM Entertainment (SM), quoted by Money Today's Star New : " We will go through administrative measures against the suspension by filing a case next week to the District Court" " We have been getting ready for this legal case on the 2nd "

은 지난 2일 오후 공식 보도자료를 통해 "청보위의 행정명령에 따라 동방신기 4집 '주문-미로틱’의 수정 버전은 제작 하겠다"면서도 "납득하기 어려운 판정이므로 관할 법원에 행정처분(유해 매체물 결정)의 효력정지 가처분 신청을 제기할 계획"라고 전했다.

" We have agreed to release a clean version of 'Jumon - Mirotic' by the administrative order, but this is something we do not agree with and feel this is entirely unfair. Therefore we have decided to file a case to the court against the administration's displosure. "

보건복지가족부 산하 청보위는 지난 11월 27일, 동방신기 4집의 타이틀곡인 '주문-미로틱' 가사가 선정적이라는 이유를 들며 이번 앨범을 청소년 유해매체로 분류했다. 이번 고시는 지난 4일부터 효력이 발생했다.

Ministry for Health, Welfare and Family Affairs administration has on the November 27th declared that DBSK's 4rth album's Mirotic's lyrics were provocative and put the album under harmful to the Youth.

청보위에 따르면 동방신기 '주문-미로틱'은 특정 단어가 아닌 가사의 전체적인 맥락에서 유해하다는 판정을 받았다.

The Comission of Youth Protection have said that the words and the meaning of 'Jumon-Mirotic' were not the only problem but the entire lyrics' meaning was harmful and overly sexual.

청보위의 판정이 확정된 직후에도 SM 측은 "결정이 나오기 전 청보위 측에 정확한 가사 해석을 제출했다"면서 "그런데도 이런 결과가 나와 당황스럽다"며 '주문-미로틱'의 노랫말은 선정성과는 전혀 관계없다는 입장을 밝혔다.

After the Comission of Youth Protection had released this statement SM.ENT said " Even before when the order had been put against MIROTIC, we have clearly negotiated and tried to explain the real meaning and explanation of the lyrics , but even after this the results came out unexpectedly and we are bewildered as of this moment" " and the JUMON -MIROTIC's lyrical meaning is entirely different and miles away from the erotic or sexual that the association is making it to be "

동방신기 4집은 지난 11월 말까지 46만 장(소속사 집계 기준)이 판매됐다. 이 수치는 올 해 국내에서 발매된 모든 가수(팀)들의 단일 앨범 중 최다이다.

DBSK's 4th album by the END OF November hit 460,000 sales ( FROM SM.ENT). This is the highest record sale for this year out of any artists/idols.

한편 현재 일본에서도 큰 인기를 누리고 있는 동방신기이기에, 이번 논란에 대한 일본 언론들의 관심도 남다르다.

However with the current condition and news coverage of DBSK's CD age ban has caused Japanese Media to release news coverage of this.. ( my friend who lives in japan said for the past 2 days she saw DBSK'S MIROTIC age ban incident on every news and entertainment news channel..ㅜㅜ...)

지 난 4일 일본 아사히TV, 니혼TV 등 방송매체는 동방신기를 아시아 스타로 표현하며 이번 논란에 대해 집중 보도했다. 또한 5일 산케이스포츠 인터넷판, 스포츠닛폰 인터넷판 등도 "유해 매체물 판정이 동방신기의 NHK '홍백가합전' 출연에는 영향을 미치지 않는다"는 내용의 기사를 내보냈다.

On the 4th, Japan's AsahiTv, Nihon Tv. etc. had released their coverage as ' Asia's Star DbSK and the bann of the CD release single MIROTIC. Sankei Sports news on the 5th, Sports-Nippon released their news " AGE ban of DBSK 4th album,, will this AFFECT DBSk's attendance for NHK's REd white ceremony?" ( the PD FOR NHK already releasd a statement said that this inicident will not prevent DBSK. at all for attendance.)

올 해 일본 오리콘 데일리 및 위클리 싱글 차트에서 수차례 1위에 오른 동방신기는 지난 11월 말 열린 일본 연말 음악 시상식인 '2008 베스트 히트 가요제'에서 2년 연속 골드 아티스트 상을 수상했다.

DBSk have also hit the top charts in Japan's Oricon charts numerous times, and have won twice in a row the golden artists award at the " Best hit Gayo Awards" Japan.

현재 동방신기는 현재 4집 후속곡 'Wrong Number'로 국내 활동을 이어가고 있다.

Currently DBSK is promoting their 4th album's WRONG NUMBER.

Personal comments:
Its funny cause there are a few songs that also contain rather vivid links to sex.
Big Bangs songs and even "One More Time" by Jewelry can not be under the 19 year old. I personally think the only reason why Mirotic is being ban is due to the fact that DBSK seems to be showing more skin than compared to their last albums. Which is kinda of dumb (i know) I also do not understand why the Youth Safety Association, if they really are trying to clean up the music scene, doesn't ban the "sexy" image many Kpop stars are conceptualizing in their stage performances and stop youngters from attending those concerts. Plus this kinda of situation has been going on for like so long. Why only start now? of all times. it doesnt make sense..

It seems to be that the Japanese seems to be covering this news rather intensly. After DBSK is making big waves in Japan with Mirotic too. So for that song and the album to be ban is just damn weird. Funny thing is that Japan is more relax compared to the Koreans. They seems to let their youth have freedom, which is something i think its also a good thing and a bad thing.

Hopefully SM will win this case. Cause i want them to win
